On May 28, the third session of the 13th National People’s Congress (NPC) in China approved Decision on Establishing and Improving the Legal System and Enforcement Mechanisms for the Hong Kong Special Administrative Region to Safeguard National Security, which has attracted widespread global attention. Therefore, I would like to make a brief introduction on the background and impacts of the Decision, to which many Icelandic friends and media may feel interested to learn more about.

5月28日,中国第十三届全国人大三次会议审议通过了《全国人民代表大会关于建立健全香港特别行政区维护国家安全的法律制度和执行机制的决定》,引起国际社会广泛关注。一些冰岛民众和媒体对该决定出台的背景及其影响不甚了解,我愿就此做一简要说明。

 

Since the return of Hong Kong to the motherland in 1997, China has been firmly implementing the principles of “one country, two systems,” “the people of Hong Kong governing Hong Kong,” and a high degree of autonomy. The practice has achieved great success in Hong Kong, yet faced with increasingly notable risks and challenges, particularly since the turbulence over proposed legislative amendments in June 2019. “Hong Kong independence” extremists, local radicals and meddling external forces have radically undermined the rule of law and social order in Hong Kong Special Administrative Region (HKSAR), severely affected Hong Kong’s economic activities and people’s livelihood, gravely threatened national sovereignty, unity, and territorial integrity, seriously challenged the bottom line of the “one country, two systems” and posed high risks on national security.

香港1997年回归以来,“一国两制”、港人治港、高度自治的方针在香港得到全面实施,取得巨大成功,但同时也面临新的风险和挑战。特别是2019年6月香港发生“修例风波”以来,“港独”分子和本土激进分子勾连外部势力严重破坏香港特区社会秩序和法治,重创香港经济和民生,严重威胁中国国家主权、统一和领土完整,挑战“一国两制”底线,给国家安全造成极大风险。

 

No government of a sovereign state will allow acts that endanger its national security on its territory. As a special administrative region of China, Hong Kong has constitutional obligation to safeguard national sovereignty, security and development interests. It has been 23 years since Hong Kong’s return, and the SAR government has made continuous efforts to complete the legislative work on safeguarding national security required by Article 23 of the Basic Law. But because of the obstruction by the opposition forces, the legislation is yet to materialize and facing possible blocks on further discussion, which leaves Hong Kong in the rare “defenseless” status in the field of national security. Efforts must be made at the state-level to establish and improve the legal system and enforcement mechanisms in order to plug the lethal loopholes in national security in Hong Kong. This approach is both necessary and urgent as to safeguard “one country, two systems”, which fully complies with the relevant provisions of the Constitution of the PRC and the Hong Kong Basic Law, and is consistent with international practice. It has won heartfelt support of the Chinese people including Hong Kong compatriots.

任何一个主权国家政府都不会允许在其国土上出现危害其国家安全的行为,香港是中国的一个特别行政区,维护国家主权、安全和发展利益是香港特区的宪制责任。回归近23年来,特区政府为完成香港基本法第二十三条有关维护国家安全的立法工作不断努力,但在反对派百般阻挠下,这一任务至今无法完成,且有被长期“搁置”的风险,使香港成为世所罕见的在国家安全上“不设防”地区。以国家立法的方式堵住香港国家安全的风险漏洞,建立健全相关法律和执行机制,是维护“一国两制”制度安全的需要,既有必要性,也有紧迫性,完全符合中国《宪法》和香港基本法有关规定,也与国际惯例相一致,得到了包括香港同胞在内的广大中国人民的衷心拥护。

 

Safeguarding national security is the essence of “one country, two systems”, as “one country” is the precondition for the viability of “two systems”, while “two systems” is subordinate to and derived from “one country”. Should the foundation be undermined, “two systems” would be out of the question. The NPC’s legislative decision targets a very narrow category of acts that seriously jeopardize national security such as secession, subverting state power and organizing and carrying out terrorist activities, as well as interference in the HKSAR’s internal affairs by external forces. It has no impact on Hong Kong’s high degree of autonomy, the rights and freedoms of speech, press, publication and assembly of Hong Kong residents or the legitimate rights and interests of foreign investors in Hong Kong. A legislative process will be set in motion following the adoption of the NPC decision. This will improve Hong Kong’s legal system and bring more stability, stronger rule of law and a better business environment to Hong Kong. It will protect the basic principle of “one country, two systems”, Hong Kong’s position as a global financial, trading and shipping center and the legitimate rights and freedoms of Hong Kong residents.

维护国家安全是“一国两制”的核心要义,“一国”是“两制”的前提,“两制”从属和派生于“一国”。“一国”原则出现动摇,“两制”就无从谈起。人大决定针对的是那些分裂国家、颠覆国家政权、组织实施恐怖活动及外国和境外势力干预特区事务的极少数严重危害国家安全的行为,不影响香港的高度自治,不影响香港居民依法享有的言论、新闻、出版、集会等各项权利和自由,不影响外国投资者在香港的正当权益。决定通过之后,将启动立法程序,这将使香港有更加完备的法律体系、更加稳定的社会秩序、更加良好的法治和营商环境,有利于维护“一国两制”的基本方针,有利于维护香港的金融、贸易和航运中心地位,有利于保障香港居民合法权益和自由。

 

Hong Kong affairs are China’s internal affairs and allow no external interference. According to the Charter of the United Nations, no State has the right to intervene in the internal affairs of any other State. I hope NPC’s decision can be viewed in a calm, objective and impartial manner, and China’s legitimate efforts to safeguard national security in Hong Kong could be appreciated with respect and support.

香港是中国的香港,不容任何外来干涉。根据联合国宪章,任何国家都不能干涉别国内政。希望大家能够冷静、客观、公正看待中国全国人大决定,理解、尊重和支持中方依法在香港维护国家安全的努力。

 

The Chinese government is rock-firm in fully and faithfully implementing the “one country, two systems” policy. It is in the common interest of the international community to see the sound and sustained implementation of “one country, two systems” and a prosperous and stable Hong Kong. I believe Hong Kong will overcome the temporary difficulties and embrace a stable and bright future.

中国政府全面准确贯彻“一国两制”方针的决心坚定不移,“一国两制”行稳致远、保持香港繁荣稳定符合国际社会的共同利益。相信香港经过短期阵痛后,必将迎来长治久安和更加美好的明天。
